Bill, S. 1982 VET HEALTH

Interesting, did you know there was a bill presented to the senate this last February. February 2014. This bill would have built 27 new veteran hospitals. It would have purchased much-needed new equipment and replaced equipment to antiquated to handle patient needs. It would have created educational programs for doctors and nurses to better equip them to handle changing patient needs resulting from daring to survive the USLESS IRAQ and the Afghan wars.

It would also allow Veteran Hospitals to accept and treat Vets with medical conditions resulting from the Iraq and Afghanistan Wars not yet listed as service connected disabilities. These medical problems would be treated but the Vet would not get disability pay. At least not until the disability is approved by the VA system. This Bill would have allowed Vets get the specialized care needed without going millions of dollars into debt.

But with the current bureaucracy unless a tank roles over your leg and at least 8 people are standing there and taking pictures. It can take anywhere up to 6 years to get a service connected classification for your medical problem. Just ask Vietnam vets how long it took them to get the VA Systems to recognize the very long list of medical problems created by Agent Orange.

But Of course cost conscious Senators like Marco Rubio Jeff Sessions and a number of other republicans have decided that this would cost just too much. So they saw fit to filibustered The Bill until it was dead.

This after forcing our military to keep open, and to train and staff 3 installations. Plus update the same Installations. Installations our military has decided serve no valuable or needed function in protecting this country and wanted to close them. Then there was an officer pay raise. Our military decided a 1% would be more than enough, but our wonderful congress decided that Officers needed a 2% cost of living raise. The same ones who decided a pay raise for us vets would cost too much.

Now let’s get into how The VA medical system operates. It works a lot like medical insurance. Although instead being based on your income the VA system is based on your medical conditions. For example, if you enter the VA Medical System without a service connected medical need you will have a $15 co-pay to see your primary care doctor. $65 if you need to see a specialist and $8 for whatever medication you might need.

Wow, ghee that is a whole money isn’t?

Now let’s say you enter VA system with a 10% service connected disability for a gunshot wound. Now let’s say 10 months after you get your 10% rating, your primary care doctor discovers a bone infection were you got shot and the infection is spreading. Because of your 10% rating, all and I do mean all treatments, tests, medications and or hospitalization your doctor’s order are covered at no charge. No treatment or medication prescribed by a doctor can be denied. Unless a board of doctors disagree with the prescribing Doctor. That’s doctors not accountants. If you get a 50% disability rating you medical bills disappear.

So you see the higher your disability rating smaller your medical bill. The February Vet bill would have allowed freshly discharged vets with little or no income seek care without going into debt.

Veteran’s Opinion

Let’s start with the fact, I am a Veteran. I have been a patient of the Veteran’s medical system for the last 15 years after my legs went bad.

Okay this is where things can get a bit confusing. The 1st time I became a part of the Veteran’s Medical System was after an honorable discharge in 1985. I enlisted in the VA Medical System because was the only medical insurance I could afford while I tried to go to school. This lasted until I took a job at the VA Hospital and worked there for almost 6 years. During those 6 years I had ‘private’ medical insurance and as an employee I had to seek my care in the civilian world. Eventually I was medically laid off because of my legs going bad. Then my insurance began rejecting treatments and procedures. That is when I returned to the VA medical system.

So as you can see I am quite familiar with both VA medical system and ‘private medicine.’ as both patient and employee. So you see I can honestly compare the 2 system.

With that said and as Ed Shultz says ‘Let’s get to work.’

The years I worked at the Denver VA Hospital it taught me that the hospital was working at capacity. There was a time we had more patients then we had beds. Often this was the result of what we called ‘dumps’. A dump is when one of the for profit hospital discovers that one of their patients is indigent or if patients insurance had reached its capacity for the year and were not going to pay anything more. If the patient is a veteran they would move that patient to a local VA Hospital.

I remember when I was assigned to a surgical intensive care unit a veteran was rolled in attached to every portable life support there was. His paperwork showed he was a ‘dump’.

Then came the budget cuts. Thanks to the republican cuts we had to close 2 wards and a medical intensive care unit. Those now unused patient rooms were turned into offices no one use and a st0ore room with nothing in it.
Then came a rare moment of sanity in which congress recognized PTSD and Agent Orange as real medical conditions. Doubling the patient load.

Now thanks to 2 useless manufactured wars the VA Patient load is quadrupling. These Veterans are seeking care with traumas and injuries that in World War II meant death.

Last year republicans cut another 29 billion from Veteran’s budget. The sequestration budget cut another 10% was cut from the VA Budget. During the Bush/Cheney years $60 billion was cut from the VA budget. Good old super smart Paul Ryan fixed it so veterans will not be getting a cost of living raise for 3 years. Hell, He has made it clear he wants to cut all disability payments to Vets and to everybody else getting help for that matter. As part of his war on wasteful social spending.

So what I don’t get is why republicans are uptight about doctor’s being forced to see 20 or more patients in day and not being able to give their patients the time they need. Plus patients waiting several months or more for visits to specialty doctors or their primary doctor.

Anyway it seems to me strange that republicans are upset because Vets are slipping through the cracks and dying.

Bankruptcy Chapter 7

Once again, I am a paralegal not a lawyer. So my articles are in no way to be considered legal advice they are legal information only. Let us not forget when a lawyer or a paralegal becomes involved your problem becomes an ISSUE.

To repeat myself, bankruptcy isn’t as bad as republicans and corporations want you to think, Just because you have a bankruptcy Discharge your life nor your financial life are not going to end, Honest. All you are doing is telling the people you owe

I ain’t got it and I can’t get it! So back off and leave me alone!”

You see the goal of all bankruptcies is Discharge. A Chapter 7 Discharge is when the Bankruptcy Trustee (Judge) says you no longer owe the money and or debts listed in your bankruptcy.

SIDENOTE: After Discharge you will have to be careful. You see There is a catch 22. You see according to Federal Law once you get your Discharge debt collectors are no longer allowed to come after you but there are bad debt collectors who will still come after you and if they can get you to pay so much as $1 it become legal to go after you again. I will get into how deal with these greedy idiots in later articles.

So getting back to after Discharge. Within 30days of getting your Discharge you will be able to get a credit cards. There will be Secured and unsecured credit cards offers. Secured credit cards require that you deposit money into a savings account. The amount you deposit in that credit card company’s savings account will be your credit limit. Six months after Discharge you will be able to buy a new car. If you want to buy a new house and use FHA loan, bummers that means you will have to wait a whole 4 years to get your new house.

SIDE-NOTE: This isn’t legal advice, just my personal opinion. After you get your discharge get a secured card that reports to the credit bureau. It will take some looking but they are out there. Warning, most secured credit cards companies report to nobody.

Now, no employer federal or private can fire you for filing for bankruptcy. You can get fired for other reasons but not for bankruptcy.

Chapter 7 bankruptcy Discharge does not mean you cannot file for unemployment benefits or that your payments are going to stop. This also includes social security or any other benefits you might be entitled to. At least not right now with the crazy republicans in power that will change.

The Discharge itself will only stay visible in your records for only 7 years.

If you are worried about the corporations and people listed in your bankruptcy they will get to deduct what you owe them from their taxes. The only thing they will lose is the interest they get to charge you while you struggle to pay off the debt.

So isn’t bankruptcy just going to destroy your life, like crazy republicans want you to think, or is it a chance to start the game over like it was always meant to be. You decide not the crazy republicans.

Debtors Prison An American Carol

All right, five months ago it is Christmas time. As usual, there was a Christmas Carol movie is playing on a number of different cable stations. I think my three favorite are Bill Murray’s Scrooge, Vanessa Williams’ a Diva’s Christmas Carol and Patrick Steward`s, A Christmas Carol. I think Mr. Steward’s came closest to what Charles Dickens wanted to say. In each movie the main plot was pretty much the same, old greedy Ebenezer Scrooge or a Scrooge type character who refuses to part with a single coin and was out to squeeze every last possible coin from poor souls no matter how or why they got into debt. It did not matter what damage or suffering his greed caused. All that mattered was putting that shiny coin into his pocket.
With that in mind, one of his favorite things to do in getting that coin, in the book, was to buy the debt of others have the unfortunate debtor arrested and jailed as a debt dodge. It didn’t matter if they were employed trying to pay or not. Debt was an actual crime in the 18th and 19th centuries. With his victim in jail, in jail without a trail or due process, Ebenezer would seize and sell their homes, furniture anything with the remotest monetary value, turning the debtors ill parents, wives and children out to suffer in the streets. You know in the real world of the 19th century single and or widowed women with children just as often wound up in debtor’s prison as men did. Debtor’s children and wives were often sent to workhouses and orphanages. Places that were too often a half a step from hell. That is if they weren’t just dumped on the streets after their house was seized.
That would be a scary world to live in wouldn’t it. Thank the Lord we don’t live in such times, right? After all it only happens in fiction and history books, right? I mean such a thing could happen not in today’s America, right?
Wrong Virginia! It is very real! And it could very well happen to you!
Just ask the Minnesota woman, who went to jail over a $250 owed for a credit card she didn’t know she had. Or The Illinois breast cancer survivor who was jailed over a $280 medical bill the hospital told her she didn’t owe. There was a woman sent to jail over a $60 phone bill owed by her husband dead 10 years. Let’s not forget the Kansas City guy who went to jail for $1000 he owed a furniture store after making payment arrangements. This last January a judge sentenced a man in Kenny Illinois to an ‘indefinite jail term’ over $300 he owed a lumber yard.
This doesn’t include to poor souls sent to jail because they didn’t have the money or a job to pay a fine. Only to discover that their $60 fine after 90 days spent in jail is now $6000. After all someone has to pay for the prison, prison guards’, food and uniforms.
After all didn’t one bund ant say “If you were a good person and a favorite of God you would have been born rich?”

Chapter. 7 Bankruptcy

Here we are once again. So as before I am a paralegal, I am not a lawyer. My articles are in no way intended to be, to be taken as, mistaken for legal advice. All right you are thinking about filing for bankruptcy. 1st thing 1st, contrary to what crazy republican’s would like you to think bankruptcy is not a bad thing. It is not going to destroy your life, it doesn’t mean you are a failure, or that you’re scammer trying to dodge your debt. All a chapter 7 bankruptcy does to restart you financial life. Kind of like asking for a ‘do over’ when you mess up playing a game.

As for your creditors, all you are doing is using the courts to tell them, “I am sorry I haven’t got it and I can’t get it. So back off.”

Now a bankruptcy is supposed to stay on your credit records for no more than 7 years. The story if you file for and are granted a bankruptcy you will be prevented from getting any credit or loans for 7 years. Plus when you do start getting credit again you will have to pay a much higher interest rate.

That is no longer true.

Will it is somewhat true. When you file your 1st bankruptcy form often called the ‘petition’ you will be unable to get any form of credit or loan until get your bankruptcy ‘Discharge’.
SIDE-NOTE: Don’t panic though. If something bad happens and you need to borrow money you have way to deal with it. You will have to get permission from the trustee though.
However not even 30 days after your ‘Discharge’ you will start receiving credit card offers. Everything from the loan shark offers:
These guys will offer high credit limits with very high interest rates. You miss a payment date with these guys by so much as an hour your interest rates will double sometimes triple. Miss a 2nd one and you could be looking at debtor’s prison.
SIDE-NOTE: Thanks to the crazy republicans and growing privatized prison system here the United States debtors prisons have become a a very real and serious threat in over 24 states. Just ask the breast cancer survivor in Illinois who went to jail 5 days after getting home from the hospital. She was arrested and jailed for a $260 hospital bill. A bill the hospital told her she did not owe. It had cost her father a $1500 to get her out. $260 for the bill she didn’t owe, $600 in legal fees, and $740 for the food she ate, for her Dad and lawyer to be processed in to see her. The rest paid for her stay at the Bar Hotel.

My Political Opinion

With all that is going on, I am going to take this week, and I am going to take this article to tell you my opinion on a few matters. One of the privileges of being a writer. Next I will be getting into Chapter 7 Bankruptcy.

So here we go, I’ve got to wonder why Bloomberg is such an evil bad guy for giving $50 million to Mothers for gun control. I mean all they are doing with his money is using the money to lobby congressmen and promote their cause.

The N.R.A. and crazy republicans are saying he is over reaching and abusing the system. Yet the Koch Brothers spend billions of dollars supporting the N.R.A. And they are claiming ‘they are such great Americans miss understood and abused.’ On 4/25/14 I watched part of the N.R.A. leader’s speech and I am really confused. He accused Democrats and Independents of passing bad laws without reading them and then going on T.V to defend them. Yet it has been republicans caught doing that for the least for the last 20 years. Regulating religion? Crazy republicans made it very clear that only a limited number Christian sects are acceptable. When did the collection of emails, cell phone records and personal data without cause or warrant is Obama’s fault? Didn’t Wayne La Pierre know that President G.W. Bush started it? Wayne La Pierre claims how news organizations are telling lies in support of certain political groups. As far as I know only Fox news and right-wing radio show have been caught in lie after lie. As far as I know CNN and MSNBC have made mistakes but they have always made prime time apologies and own up to it. Fox never has nor has Fox ever admitted their fact ‘mistakes’ and I have watched a few of their lame attempts to cover things up.

When did it become okay for someone who makes anywhere up to $100,000 a year and refuses pay one bills is a hero and someone who had been desperately searching for a job for the last three to four years loses and their unemployment insurance has to go to jail for feeding their kids. Shanesa Taylor of Arizona went to jail for trying to get a job to feed her kids. Just so you know debtor’s prisons in the United States is very real. Thousands of men and women have gone to jail for owing as little as $1000. Privatized juvenile jails are keeping their prisoners months past their release dates to fatten that prisons bills to the State.

Why do multi-billion dollar corporations deserve more in tax cuts and subsidies? To get paid just for existing in the States. And I have to pay more in taxes, and lose food stamps, A.C.A Medicare social security. To lose some of my tax deductions. To have A rich man’s son should go to college and while my nephews can’t. The Paul Ryan budget.
Why was it okay on that but unemployment insurance ‘sorry it’s just not that important.’?

You know I have even read an article about a private juvie prison in Florida being investigated for selling their male and female prisoners sexual services, like I said I am confused?

S.C.R.A IV

Interesting according to Congressional Budget Office Obamacare is going to cost 5 billion dollars less than we’ve been told to expect.

This means according to the Washington post premiums should be going to go down.

Isn’t that just awful and such a really bad thing to have happen. I mean for the past 30 years all my premiums ever did was to go up. This happened every year for the exact amount of my cost of living raise. Isn’t that the way it is supposed to be?

To work than. I am a paralegal not a lawyer so what information you find in my articles are not to be taken as legal advice. My articles are meant to be legal information only. Let’s not forget when a lawyer of paralegal becomes involved your problem becomes an Issue.

OPINION: The fact it can take your lawyer 2 or 3 days to get up to speed on your ISSUE is one of the main reasons why, waiting to the last moment before getting legal help is a very bad idea. It always takes your lawyer and or paralegal awhile process the information and to get up to speed before they can help you. So the more time you can give your lawyer the happier you will be with the results.

Something interesting for soldiers if you get arrested and dropped into a civilian jail and a bail bondsman gets you out you can use the S.C.R.A. to block them from coming after you and forcing you to appearance for your court date until 90 days after discharge from the military.

However this only works if you are in combat. If you are stationed at a base in the States of an Ally country the bondsman can go your commanding officer and ask for you. Or the bondsman can go to your base legal office and get the base court to cancel that part of your S.C.R.A.

Now getting back to what your spouse can do with S.C.R.A. As I said before using the S.C.R.A. your spouse can stop a foreclosure on your house or stop a rental eviction. Also Using the S.C.R.A your spouse can stop a foreclosure on your storage unit.

Life Insurance: Okay if you or your soldier has one of those life insurance policies you can borrow against and your soldier uses it as collateral before going on active duty. Using the S.C.R.A. you can prevent the creditor from seizing the money. Unless the insured dies or the premiums don’t get paid.

Now it is always a good idea to have a back-up P.O.A. /Power of Attorney. A back-up P.O.A/Power of Attorney doesn’t come into play unless your spouse is out of it. It also helps is States that still won’t see same sex unions.

Getting back to the S.C.R.A. If your spouse is out of the game whoever is listed on your back-up P.O.A can use the S.C.R.A., too protect your assets.

Let me start with the fact that there are two types of republicans. There are Republican’s who are defiantly old school republican. President Lincoln old school. They believe what you get in life depends on how much work and effort you put into achieving it.
Then there are crazy republicans, who seem to believe ‘if you were a good person would have been born rich. So if you are poor than you must be bad, and if you are bad it is God’s will you that you must be punished. Who am I to go against the will of God?’

S.C.R.A III

Interesting, our House of Representatives has actually held a vote on 4/10/14. 219 crazy republicans have voted to cut and end food stamps, Medicare and Medaid, Unemployment insurance, welfare and other much needed social programs. For example, there would be cuts to the Pell grant making it 10 times harder for a poor kid to get education or training needed so they can climb out of being poor. Of course, let’s not forget Obama care this budget will be taking away medical insurance from 8 million working families. After all the poor and handicap are just lazy people bleeding this country dry.

All this so they can to give poor rich people a much needed tax cuts. Poor, Poor rich people. I swear Serf-Dom is on its way back. Once we have Serf-Dom slavery is not even a half-step away.

Picking up on the S.C.R.A. I am constructing a second page dedicated to listing phone numbers, addresses and websites of military legal assistance organizations. I found this listing on the Department of Justice website. Theses organizations’ should and will be able to help you if you decide to pursue an S.C.R.A/Serviceman’s Civil Relief Act type of bankruptcy. If you live near a military base you can also start with local military base’s legal offices.

If you are a service member and or the service member’s spouse starting an S.C.R.A you will need to have this the information you need to have on hand when you make your 1st call:

Service member’s full and complete name, rank and current posting or where they are currently stationed. Of course don’t forget your soldier’s social security number.

Next gather together all information you can about the money matter you need help with. This includes all bills, demand letters, contracts, deeds and bills of sales. This also includes any legal documents, like Reposition demands, notices of evictions, and foreclosures’ notices. Make sure you have all this information organized in such a way you can easily find what information you need while are talking with your lawyer.

It will help to write down a list of your questions and concerns before making your 1st call and have it on top of your paperwork.

Once you have gotten all your information put together, you can make your 1st call.

SIDENOTE: Do not be surprised or appalled if after the intake operator takes your phone number and some information about your issue they tell you someone will be calling you back. This is a legal and governmental office you are dealing with after all. It could be 2 or 3 days before someone call you back but I guarantee someone will call. However if someone is pounding at your door about the debt make sure the intake operator is aware! Someone will call you back a lot sooner.
If someone from that office doesn’t call in that time frame or the collection agent starts getting scary you can call the intake operator again ask them to hurry it along.

More about the S.C.R.A next week. Then there should be a couple more S.C.R.A postings and then I will be moving on to Chapter 7 bankruptcy.

Obama goes to War.

I apologies about being gone for so long but problems do happen. So please Excuse me as I go political this week. It is so cool writing for a blog that lets me go off on these tangents every now and then.
So as Ed, from the Ed Show say ‘Let’s get to work.’ This last Thursday President Obama declared war. He attacked Putin right in the wallet. SMP Bank of Russia/ St. Petersburg-based Bank Rossiyahas has been isolated. His sanctions blocks the bank from doing business with any bank or financial institution that is American owned or operated.
President Obama also blocked a lot of Putin’s rich friends from accessing their assets held in the United States.
You see President Obama went radical. Much to the displeasure of the crazy republican. Instead of risking expendable assets, living soldiers, Obama has placed assets much too valuable at risk. MONEY.
President Obama’s actions has greatly displeased crazy republicans So much so they are now allowing MasterCard and Visa to resume doing business with the SMP Bank.
They are even blocking further sanctions. Trying to make Obama look weak and useless. You know with some of the history, I have learned lately. Like The real reasons for the Iraq war reasons, Regan torpedoes Carter’s efforts to free the hostages then buying their freedom with arms after being elected, Nixon blocking LBJ’s ending of the Vietnam War so he can get elected,
I have got to wonder if there isn’t somebody egging him on trying to create yet another war. You know Uncle Sam buys multi-billions of dollars of weapons during a war that are never used. After all those weapons are much more valuable than living soldiers.
With the treatment our soldiers receive when they get home, and waiting years for their promised benefits. That is if they are not denied because some paper pusher decides one of their forms wasn’t filled out exactly right. If that happens than the poor veteran has to refill out the paperwork and wait an outer four years. Just to let you know there have been bills put forth by Obama and the democrats to speed up the process but once again crazy republicans have blocked those bills. Then comes Food stamps being cut so veterans can’t feed themselves or their children while waiting for their promised benefits. And after 10 to 15 years of being shot at, and or blown up or veteran’s when after discharged are booted out the door and told go be normal. Are told, if you have a problem dealing with the world after 10 years of terror, or your body is so severely damaged you can’t find or maintain a job. Well sorry about that but if you complain you are just useless and weak so don’t bother us with your problems. Oh yeah, that unemployment insurance you’re supposes to get after your discharge, oh well sorry about that.
Making it very clear, at least to me that crazy republican’s believe soldier are the least valuable and most expendable assets.
Is it any wonder 22 or more veterans are taking their own lives every single day?
